Boxen Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Boxen website, online ordering platform and meal services. By accessing our website, creating an account or placing an order, you agree to these Terms.

 

If you do not agree to these Terms, please do not use our website or place an order.

 

1. About Boxen

 

Boxen LLC (“Boxen,” “we,” “us” or “our”) is a locally owned prepared-meal service serving eligible delivery areas in Brevard County, Florida.

2. Eligibility and Customer Information

 

You must be at least 18 years old or have permission from a parent or legal guardian to place an order.

 

You agree to provide complete and accurate information when ordering, including your name, email address, mobile number, delivery address and any necessary delivery instructions.

 

You are responsible for keeping your account and contact information current.

 

3. Weekly Menus and Availability

 

Boxen offers a rotating selection of freshly prepared meals, add-ons and bulk protein options. Menu items, ingredients, portions, pricing and availability may change from week to week.

 

Quantities may be limited. Placing an item in your cart does not reserve it. An order is not confirmed until checkout and payment have been completed.

 

Boxen may limit quantities, discontinue an item or decline or cancel an order when reasonably necessary. If Boxen cancels an order or item after payment has been collected, the affected amount will be refunded or credited.

 

4. Ordering and Payment

 

Orders must be placed before the weekly ordering cutoff displayed on our ordering site.

 

Payment is collected when an order is placed. You authorize Boxen and its payment processor to charge the payment method submitted at checkout for the order total, including applicable taxes, delivery charges, cooler deposits or other disclosed fees.

 

Prices and promotions are subject to change. The pricing displayed at checkout at the time of purchase controls.

 

You are responsible for reviewing your order, selected meal options, quantities, delivery address and contact information before completing checkout.

 

5. Changes, Cancellations and Refunds

 

Orders may be changed or canceled before the weekly ordering cutoff displayed on our ordering site.

 

Once the ordering cutoff has passed, orders are final and cannot be changed, canceled or refunded. This allows Boxen to purchase and prepare ingredients specifically for the number of meals ordered.

 

To request a change before the cutoff, contact info@mealboxen.com. A request is not complete until Boxen confirms the change or cancellation.

 

6. Delivery Schedule and Service Area

 

Boxen currently provides local delivery to eligible locations in Brevard County, Florida. Availability is determined by the delivery address entered during checkout.

 

Our regular delivery day is Monday unless otherwise stated on the ordering site or communicated directly to the customer.

 

Delivery dates, routes and estimated arrival windows may change because of order volume, traffic, weather, holidays, staffing, vehicle issues or circumstances outside Boxen’s reasonable control.

 

An estimated delivery window is not a guaranteed delivery time.

 

Applicable delivery fees and free-delivery thresholds will be displayed during ordering and may change.

 

7. Delivery Communications

 

Boxen generally confirms delivery timing by SMS before delivery. By providing a mobile number, you agree to receive transactional communications relating to your order, including delivery reminders, estimated arrival times and delivery confirmations.

 

Message and data rates may apply. Customers are responsible for ensuring that the mobile number submitted with the order is accurate and able to receive messages.

 

Opting out of text messages may prevent you from receiving important delivery updates. Marketing messages, if offered, are subject to any separate consent and opt-out terms provided when you subscribe.

 

8. Customer Delivery Responsibilities

 

Customers are responsible for providing:

 

  • A complete and accurate delivery address

  • A current mobile number

  • Gate, building or community access codes

  • Apartment, suite or unit information

  • Clear delivery-location instructions

  • A safe and reasonably accessible place for the order

  • Notice of loose animals or other access concerns

 

Drivers are unable to return later in the day solely because the delivery location was inaccessible, the information provided was incomplete or incorrect, or no safe delivery location was available.

 

If delivery cannot be completed because of an incorrect address, locked gate, missing access code, inaccessible building, loose animal, unsafe condition or another circumstance outside Boxen’s reasonable control, the order may not be eligible for a refund. Additional delivery arrangements or charges may apply if redelivery is available and authorized by Boxen.

 

9. Unattended Deliveries

 

You do not need to be present to receive your delivery.

 

If you will not be available, you should leave an insulated cooler with sufficient ice packs in a shaded, secure and accessible location. Any cooler-location instructions should be included with your order.

 

Unless other arrangements have been confirmed, Boxen may leave the order at the delivery location provided by the customer. Delivery is considered complete when the order is placed at that location and delivery confirmation is recorded or communicated.

 

Once delivery has been completed, the customer is responsible for retrieving and refrigerating the meals promptly. Boxen is not responsible for theft, animals, weather exposure, extended outdoor storage, spoilage or other loss occurring after successful delivery.

 

Leaving a cooler does not extend Boxen’s responsibility for the order after delivery.

 

10. Reusable Cooler Bag Deposit

 

When available, customers may purchase or place a refundable deposit on a reusable Boxen cooler bag supplied with an ice pack. The applicable amount will be displayed when ordering.

 

To qualify for a refund or account credit, both the Boxen cooler bag and accompanying ice pack must be returned in reusable condition.

 

Normal wear from ordinary use is acceptable. Deposits may not be refunded for bags or ice packs that are missing, excessively soiled, damaged or no longer reusable.

 

Returns may be collected during a future Boxen delivery or handled through another return method approved by Boxen. Any refund or account credit will be issued after the returned items have been received and inspected.

 

Cooler availability is not guaranteed.

 

11. Meal Storage and Food Safety

 

Meals must be refrigerated promptly after delivery and kept refrigerated until ready to eat.

 

Customers must follow all storage, reheating and use-by instructions provided by Boxen. Hot meals should be reheated thoroughly to an internal temperature of 165°F unless different instructions are provided for a particular item.

 

Boxen cannot guarantee the safety or quality of meals that have been:

 

  • Left unrefrigerated after delivery

  • Stored outside a safe temperature range

  • Kept beyond the recommended use-by period

  • Improperly reheated

  • Frozen or thawed improperly

  • Altered, repackaged or handled contrary to the provided instructions

 

Customers are responsible for determining whether a meal has been stored and handled safely after delivery. When in doubt, discard the meal.

 

12. Ingredients, Allergens and Dietary Needs

 

Boxen provides ingredient information to help customers make informed ordering decisions. However, recipes and available ingredients may change.

 

Meals are prepared in a shared kitchen where common allergens are present, including milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy and sesame.

 

Although we take reasonable care during preparation, Boxen cannot guarantee that any meal or ingredient is completely free from allergens or cross-contact.

 

Terms such as “gluten-friendly” describe meals that are not intentionally prepared with gluten-containing ingredients but do not mean that the meals are certified gluten-free or prepared in a dedicated gluten-free facility.

 

Customers with severe food allergies, celiac disease or medically necessary dietary restrictions should contact Boxen before ordering and should not rely solely on abbreviated menu descriptions.

 

Boxen does not provide medical or nutritional advice. Customers are responsible for determining whether a meal is appropriate for their individual health, allergy or dietary needs.

 

13. Ingredient Substitutions

 

Ingredient availability may occasionally require a reasonable substitution.

 

When practical, Boxen will select a substitute that preserves the intended character and quality of the meal. However, substituted ingredients may affect allergens, nutrition information or dietary suitability.

 

Customers with food allergies or strict dietary needs should review current ingredient information and contact Boxen with questions before ordering.

 

14. Nutrition and Portion Information

 

Boxen makes reasonable efforts to provide accurate nutrition and portion information.

 

Because meals are prepared and portioned by hand, ingredient brands may change and natural ingredients vary, actual portion sizes and nutritional values may differ from the estimates shown.

 

Nutrition information is provided for general informational purposes and should not be considered medical advice or a guarantee of exact values.

 

When customers select a different base, protein quantity or meal option, the nutrition information displayed for that selection should be reviewed before checkout.

 

15. Quality Concerns and Order Problems

 

If an item is missing, incorrect, damaged or presents a quality concern, contact Boxen as soon as possible after delivery at info@mealboxen.com.

 

Please include:

 

  • Your name and order information

  • The affected item

  • A description of the concern

  • A photograph when relevant

 

Depending on the circumstances, Boxen may provide a replacement, Boxen account credit or refund.

 

Boxen reserves the right to review the circumstances of each request. Remedies are not guaranteed when a concern results from improper storage, delayed retrieval, customer handling, inaccurate delivery information or circumstances outside Boxen’s reasonable control.

 

16. Refunds

 

Approved refunds will generally be returned to the original payment method. Processing times may vary depending on the payment provider or financial institution.

 

Promotional credits, loyalty points and account credits have no cash value and may be returned as account credit rather than cash.

17. Boxen Points, Referral Credits and Promotions

 

Boxen may offer loyalty points, referral incentives, promotional codes, discounts or account credits.

 

Unless otherwise stated:

 

  • Offers may not be combined.

  • Offers apply only during the stated promotional period.

  • Promotional value has no cash value.

  • Credits and points cannot be transferred or exchanged for cash.

  • Discounts cannot be applied retroactively.

  • Eligibility requirements and exclusions may apply.

  • Boxen may correct points or credits issued because of error, cancellation, refund, misuse or suspected fraud.

 

Boxen may modify or discontinue a loyalty or referral program prospectively. Previously earned, valid credits will be handled according to the terms in effect when they were earned, subject to any disclosed expiration date.

 

18. Gift Cards and Account Credits

 

If offered, Boxen gift cards and account credits may be used only for eligible purchases through the Boxen ordering platform.

 

Gift cards and credits cannot be redeemed for cash except where required by law. Boxen is not responsible for unauthorized use resulting from a customer’s failure to safeguard account or gift-card information.

 

Additional terms presented when a gift card or credit is issued will also apply.

 

19. Website and Ordering-Platform Use

 

You may use the Boxen website and ordering platform only for lawful, personal and legitimate business-ordering purposes.

 

You may not:

 

  • Attempt to interfere with the website or ordering platform

  • Access another person’s account without authorization

  • Submit false, misleading or fraudulent information

  • Use automated systems to scrape, copy or disrupt the website

  • Reproduce or commercially exploit Boxen content without permission

  • Misuse promotional codes, loyalty points, referrals or payment systems

 

Boxen may restrict or terminate access when reasonably necessary to protect customers, the business or its service providers.

 

20. Intellectual Property

 

The Boxen name, logo, branding, photographs, website design, written content, menu descriptions and other original materials are owned by Boxen LLC or used with permission.

 

These materials may not be copied, reproduced, modified, distributed or used commercially without prior written permission from Boxen.

 

Customers may share links to Boxen’s public website and social-media content for personal, noncommercial purposes.

 

21. Third-Party Services and Links

 

Boxen may use third-party providers for online ordering, payment processing, text communications, website hosting and delivery support.

 

Your use of those services may also be subject to the provider’s terms and privacy practices.

 

Boxen’s website may contain links to third-party websites. Boxen does not control and is not responsible for the content, availability, security or privacy practices of third-party sites.

 

22. Privacy

 

Information submitted through the Boxen website or ordering platform is handled according to our Privacy Policy and the applicable policies of our service providers.

 

Payment information is processed by third-party payment providers. Boxen does not necessarily receive or retain complete payment-card information.

 

23. Events Outside Boxen’s Control

 

Boxen is not responsible for delays, substitutions, service interruptions or failure to perform caused by events outside its reasonable control, including severe weather, natural disasters, power outages, equipment failures, vehicle issues, road closures, government actions, public-health events, labor disruptions or supplier shortages.

 

When these events affect an order, Boxen will make reasonable efforts to communicate with affected customers and determine an appropriate resolution.

 

24. Disclaimer of Warranties

 

To the fullest extent permitted by law, Boxen’s website, ordering platform and services are provided on an “as available” basis.

 

Boxen does not guarantee uninterrupted website access, the availability of every menu item or that all website content will always be completely free from typographical or technical errors.

 

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

 

25. Limitation of Liability

 

To the fullest extent permitted by law, Boxen LLC will not be liable for indirect, incidental, special or consequential losses arising from the use of our website, ordering platform or services.

 

For a claim relating to a specific order, Boxen’s total liability will not exceed the amount paid for the affected order, except where a different remedy is required by law.

 

This limitation does not apply to liability that cannot lawfully be limited or excluded.

 

26. Governing Law

 

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

 

Any legal proceeding relating to these Terms or Boxen’s services must be brought in a court with proper jurisdiction in Brevard County, Florida, unless applicable law requires otherwise.

 

Before beginning a legal proceeding, the parties agree to make a reasonable good-faith effort to resolve the concern directly.

 

27. Severability

 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. The affected provision will be enforced to the greatest extent permitted by law.

 

28. No Waiver

 

If Boxen does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

 

29. Changes to These Terms

 

Boxen may update these Terms to reflect changes to our services, policies or legal obligations.

 

The revised Terms will be posted on this page with an updated “Last Updated” date. Changes apply to orders placed after the revised Terms are posted unless otherwise stated or required by law.

 

30. Entire Agreement

 

These Terms, together with the policies referenced within them and any terms displayed during checkout, constitute the agreement between the customer and Boxen regarding the website, ordering platform and meal services.

 

If checkout terms specific to a particular order conflict with these general Terms, the order-specific checkout terms will control for that order.
